Terms of Service

Welcome to TelluricAI. These Terms of Service ("Terms") govern your use of the TelluricAI mobile application ("App", "Service") provided by TelluricAI ("we", "our", or "us"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using TelluricAI, you confirm that you:

• Are at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Will comply with all applicable laws and regulations
• Accept our Privacy Policy

2. Description of Service

TelluricAI is an on-device AI assistant application that:

• Provides conversational AI capabilities using locally-processed language models
• Offers text, voice, and image-based interactions
• Processes all AI computations on your device
• Provides optional web search functionality (Pro subscription)

3. User Accounts

TelluricAI does not require account creation. Your use of the App is anonymous by design. Subscription status is managed through your Apple ID and the App Store.

4. Subscriptions and Payments

4.1 Free Tier

The free version of TelluricAI provides access to:

• Selected AI models (up to 1.7B parameters)
• Unlimited conversations
• Voice input capabilities
• Live conversation mode
• System text-to-speech voices

4.2 Pro Subscription

TelluricAI Pro is available as:

• Monthly subscription
• Annual subscription (with discount)

Pro features include:

• Access to all 15+ AI models (up to 8B parameters)
• Vision-language models for image analysis
• Web search and URL content fetching
• Premium Telluric neural voices
• Early access to new features

4.3 Billing

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited upon purchase of a subscription

4.4 Refunds

All purchases are processed by Apple. Refund requests should be directed to Apple through their standard refund process at reportaproblem.apple.com.

5. Acceptable Use

You agree to use TelluricAI only for lawful purposes. You may NOT use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that exploits or harms minors
• Generate spam, malware, or malicious code
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the AI models
• Use automated systems to access the Service in a manner that exceeds reasonable use
• Circumvent any access restrictions or subscription limitations

6. AI-Generated Content

6.1 Nature of AI Responses

TelluricAI uses artificial intelligence language models to generate responses. You understand and agree that:

• AI responses are generated algorithmically and may contain errors, inaccuracies, or inappropriate content
• The AI does not have personal opinions, emotions, or consciousness
• Responses should not be relied upon for medical, legal, financial, or other professional advice
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content

6.2 Content Ownership

• You retain ownership of any content you input into the App
• AI-generated responses are provided for your personal use
• You are responsible for how you use AI-generated content

6.3 Content Moderation

While the AI models are designed with safety measures, we cannot guarantee that all generated content will be appropriate. You can report concerning responses through the in-app reporting feature.

7. Intellectual Property

7.1 Our Rights

TelluricAI, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. The underlying AI models are licensed from their respective creators.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile any part of the App
• Remove any proprietary notices or labels
• Use our trademarks without permission

8. Privacy

Your privacy is fundamental to TelluricAI. Please review our Privacy Policy to understand how we handle data. Key points:

• All AI processing happens on your device
• We do not collect or store your conversations
• Your data remains under your control

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted or error-free
• AI responses will be accurate or appropriate
• The Service will meet your specific requirements
• Any errors will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TelluricAI and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share using the Service

12. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is harmful to us or our interests

You may stop using the Service at any time by uninstalling the App.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or our website. Your continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TelluricAI regarding your use of the Service.

18. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and TelluricAI, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
